Arbor Realty Capital Advisors, Inc. (“ARCA,” “we,” “us,” “our”) respects your privacy. This Privacy Policy explains what personal information we collect through the website at arcainc.us (the “Site”), how we use it, who we share it with, and the rights you have under California law.
This policy is written to satisfy our obligations under the California Consumer Privacy Act of 2018 as amended by the California Privacy Rights Act of 2020 (together, the “CCPA / CPRA”), as well as other applicable U.S. privacy laws. It is not a substitute for legal advice.
1. Scope
This Privacy Policy applies to personal information we collect on the Site, through email and other electronic communications with us, and through ARCA’s contact, valuation request, and scheduling forms. It does not apply to information you provide directly to a counterparty in a transaction, to a qualified intermediary, to your CPA or attorney, or to third-party platforms that we link to. It also does not apply to information collected in our role as a fiduciary to a client under a separately executed representation agreement, where applicable separate confidentiality terms control.
2. Personal Information We Collect
In the past 12 months, we have collected or may collect the following categories of personal information described in California Civil Code section 1798.140:
Identifiers. Name, business name, postal address, email address, telephone number, and IP address, where you submit them to us or where they are captured by standard web analytics.
Customer records. Information you provide in a contact form, valuation request, or scheduling tool, including your role with respect to a property (owner, buyer, advisor, fiduciary), the property address or portfolio you are asking us about, and any context you choose to include.
Commercial information. Information about your real estate holdings, transaction history, exchange timelines, and asset-class focus where you provide that information to us in connection with an inquiry.
Internet or other electronic network activity. Pages visited, time on page, referrer URL, device and browser type, approximate location derived from IP, and similar analytics data captured by our website analytics tools.
Professional or employment information. Your title, firm, and role, where you provide them.
Inferences. We may derive limited inferences from the above, for example whether an inquiry is likely from an owner, buyer, advisor, or recruiter, in order to route the inquiry to the appropriate ARCA team member.
We do not knowingly collect sensitive personal information as defined under the CPRA (such as Social Security number, driver’s license number, precise geolocation, contents of mail or messages, biometric data, or information about racial or ethnic origin, religious or philosophical beliefs, union membership, sexual orientation, or health) through the Site.
3. Sources of Personal Information
We collect personal information from:
- You directly, when you fill out a form, send an email, schedule a call, or otherwise interact with us through the Site
- Automated tools (cookies, web beacons, analytics scripts) running on the Site
- Service providers that operate scheduling, analytics, email, and similar functions on our behalf
- Public sources, including the California Department of Real Estate licensee database, county recorder offices, and similar public records, where we research a transaction or counterparty
4. How We Use Personal Information
We use personal information to:
- Respond to your inquiries and conduct conversations about possible engagements
- Provide the services described in a separately executed representation agreement
- Send you market reports, the ARCA SoCal Cap Rate Index, and similar updates, where you have opted in
- Operate, maintain, secure, and improve the Site
- Detect and prevent fraud, abuse, or unauthorized access
- Comply with our legal, regulatory, and licensing obligations under California, Georgia, and other applicable jurisdictions
- Establish, exercise, or defend legal claims
5. How We Share Personal Information
We share personal information only in the following circumstances:
Service providers. Companies that operate the Site, host content, send email on our behalf, provide analytics, provide scheduling, manage our customer relationship and marketing data, or provide email obfuscation and tracking. These providers are contractually limited to using personal information only for the purposes for which we engage them.
Professionals you direct us to. If you ask us to coordinate with your CPA, tax attorney, qualified intermediary, or other advisor, we will share what is necessary to do so.
Counterparties in a transaction, with your authorization. If we are representing you and a transaction is in progress, we share what is necessary with the counterparty, escrow, title, lender, and similar parties, consistent with our duties under the California DRE rules.
Legal requirements. We may disclose personal information in response to a subpoena, court order, or other lawful request, or where we reasonably believe disclosure is necessary to protect our rights, property, or safety, or that of our clients or the public.
Business transfers. If ARCA is involved in a merger, acquisition, financing, or sale of assets, personal information may be transferred as part of that transaction, subject to confidentiality protections.
6. Sale or Sharing of Personal Information
We do not sell personal information for monetary consideration, and we do not share personal information for cross-context behavioral advertising as those terms are defined under the CCPA / CPRA. We do not use personal information for targeted advertising across third-party websites and apps.
7. Cookies and Similar Technologies
The Site uses cookies and similar tracking technologies. The cookies set on the Site fall into the following categories:
Strictly necessary. Required for the Site to function (session management, security).
Functional. Used to remember preferences and improve usability.
Analytics. Used to understand how visitors use the Site so we can improve it. The analytics provider receives aggregated and de-identified data where technically possible.
You can configure your browser to refuse some or all cookies, or to alert you when cookies are being sent. If you refuse cookies, some Site features may not function as designed.
The Site honors Global Privacy Control (“GPC”) signals. If your browser transmits a GPC signal, we will treat it as an opt-out of any sale or sharing of personal information for that browser, to the extent applicable.
8. Your California Privacy Rights
If you are a California resident, you have the following rights under the CCPA / CPRA, subject to the exemptions and limitations in the statute:
- Right to know. You may request that we disclose the categories of personal information we have collected about you, the sources of that information, the business purposes for collecting it, the categories of third parties with whom we have shared it, and the specific pieces of personal information we have collected about you.
- Right to delete. You may request that we delete personal information we have collected from you, subject to legal and operational exceptions (for example, information we are required to retain to comply with real estate licensing, anti-money-laundering, or tax record-keeping rules).
- Right to correct. You may request that we correct inaccurate personal information we maintain about you.
- Right to opt out of sale or sharing. As stated in Section 6, we do not sell or share personal information for cross-context behavioral advertising. If our practices change, we will update this policy and provide an opt-out mechanism in compliance with the CCPA / CPRA.
- Right to limit use of sensitive personal information. As stated in Section 2, we do not collect sensitive personal information through the Site. If our practices change, we will update this policy.
- Right to non-discrimination. We will not discriminate against you for exercising any of these rights.
- Right to portability. You may request that we provide a copy of your personal information in a portable, machine-readable format.
9. How to Exercise Your Rights

We will verify your identity before responding, using reasonable methods proportionate to the sensitivity of the information and the risk of harm from unauthorized disclosure. We may ask you to provide information that allows us to confirm you are the person whose personal information we collected.
If you make a request through an authorized agent, the agent must provide written authorization signed by you and proof of identity. We may require you to verify your identity directly with us.
We will respond to your request within 45 days of receipt, with the option to extend by 45 additional days as permitted under the CCPA / CPRA. If we cannot fulfill a request in whole or in part, we will explain why.
10. Children
The Site is not directed to children under 16. We do not knowingly collect personal information from children under 16. If you believe we have inadvertently collected such information, contact us and we will delete it.
11. Data Retention
We retain personal information for as long as needed to fulfill the purposes for which it was collected, to comply with our legal and regulatory obligations (including California DRE record-keeping requirements, which generally require brokerage transaction records to be retained for three years from the date of closing or rejection of an offer), to resolve disputes, and to enforce our agreements. When personal information is no longer needed, we delete it or de-identify it.
12. Security
We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, and disclosure. No security program is perfect, however, and we cannot guarantee that personal information will never be accessed or disclosed in a manner inconsistent with this policy.

13. Third-Party Services
The Site uses third-party services that may collect their own information about you, subject to their own privacy policies. These currently include:
- Web hosting and content delivery
- Website analytics
- Scheduling and calendar integration
- Email delivery and tracking
- Form processing
- Customer relationship management
- Accessibility tooling
We endeavor to engage providers that meet reasonable privacy standards. We are not, however, responsible for their policies or practices.
14. Out-of-State and International-Users
The Site is operated from the United States. If you access it from outside California or outside the United States, your information may be transferred to and processed in California and other states under U.S. law. We do not currently target the Site to residents of jurisdictions outside the United States, and we make no representations about whether the Site complies with the laws of other jurisdictions, including the European Union’s General Data Protection Regulation.
15. Changes to This Policy
We may update this Privacy Policy from time to time. The “Last updated” date at the top of this policy reflects the most recent revision. Material changes will be flagged at the top of this page for at least 30 days.
