These Terms of Use (the “Terms”) govern your access to and use of the website at arcainc.us (the “Site”), operated by Arbor Realty Capital Advisors, Inc. (“ARCA,” “we,” “us,” “our”). By accessing the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. About Us

Arbor Realty Capital Advisors, Inc. is a California real estate brokerage holding California Department of Real Estate Corporation License No. 01980430, with offices at 180 S Lake Avenue, Suite 205, Pasadena, California 91101. Our principals are individually licensed real estate brokers and salespersons under the California DRE. Where we transact in other states, we hold or are sponsored by appropriate licensure in those jurisdictions.

2. What the Site Is

The Site is informational. It describes our services, our team, representative engagements, and market data we publish. The Site is not a transaction platform. Nothing on the Site constitutes an offer to sell, a solicitation to buy, or a contract of any kind. Engagements with ARCA are formed only through a separately executed written representation agreement.

The Site, the ARCA SoCal Cap Rate Index, market commentary, and any other published analysis are provided for general information only. They are not investment advice, legal advice, tax advice, or accounting advice, and should not be relied on as the basis for any transaction. Consult your own qualified advisors before acting on any information you find here.

Where the Site discusses 1031 exchanges, drop-and-swap transactions, partnership structures, or other tax-sensitive topics, those discussions are general descriptions of commonly used techniques. They are not tailored advice and may not apply to your facts and circumstances. The Internal Revenue Code and California Revenue and Taxation Code change frequently, and only your CPA, tax attorney, and qualified intermediary should advise you on whether and how to proceed.

4. Property Listings and Market Data

Information on properties listed for sale or lease, market statistics, capitalization rates, rent comparables, transaction histories, and submarket data appearing on the Site is sourced from CoStar, public records, MLS systems, and third-party providers we believe to be reliable. We do not, however, warrant the accuracy, completeness, or currency of that information. All property information is subject to errors, omissions, change of price or terms, prior sale or lease, or withdrawal without notice. Buyers, lessees, and their advisors should independently verify all information before acting.

Square footage, unit counts, zoning, entitlement status, and other property characteristics shown on the Site are approximations unless explicitly verified in a representation agreement and accompanying due diligence materials.

5. Forward-Looking Statements

Forecasts of market conditions, cap rate trends, rent growth, vacancy, and similar projections are forward-looking by nature. They reflect our judgment as of the date published and are subject to risks, uncertainties, and changes in market and regulatory conditions. Actual outcomes may differ materially. We disclaim any obligation to update forward-looking statements after they are published.

6. Use of the Site

You may use the Site for lawful, personal, and ordinary business purposes. You may not:

  • Scrape, harvest, or systematically download content from the Site for commercial use
  • Use automated tools to access the Site in a manner that interferes with its operation
  • Use the Site to transmit malicious code, spam, or unlawful content
  • Attempt to gain unauthorized access to non-public portions of the Site, our infrastructure, or our systems
  • Impersonate any person or entity, including any ARCA personnel
  • Use the Site in a manner that violates any applicable law, including California real estate, fair housing, securities, and consumer protection laws

7. Intellectual Property

The Site, including all content, design, layout, photographs, graphics, video, market analyses, the ARCA SoCal Cap Rate Index methodology, and software, is owned by ARCA or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. “Arbor Realty Capital Advisors,” the ARCA wordmark, “ARCA SoCal Cap Rate Index,” and “Institutional capabilities. Boutique accountability.” are trademarks of ARCA.

You may view, save, and print individual pages for personal or ordinary business reference. Any other use, including reproduction, redistribution, modification, derivative works, framing, or commercial republication, requires our prior written consent.

Submissions you make through the Site (for example, valuation requests, contact form messages, or other materials) grant ARCA a non-exclusive, royalty-free, worldwide license to use that information in the ordinary course of evaluating, responding to, and servicing your inquiry. We will handle personal information you submit in accordance with our Privacy Policy.

The Site contains links to third-party websites and embeds third-party tools (for example, scheduling, mapping, virtual tour, or analytics services). Those sites and tools are not under our control. Their terms and privacy policies govern your use of them. We are not responsible for their content, accuracy, or privacy practices.

9. Cap Rate Index and Other Published Data

The ARCA SoCal Cap Rate Index and similar published market data are derived from third-party data sources (including CoStar) and ARCA’s professional judgment. They are not financial benchmarks, regulated indices, or investment products. They are intended as informational tools to inform conversations with clients and prospects. ARCA does not represent that any property will transact at a rate within the Index, and the Index should not be used as the basis for any pricing decision without independent verification and professional advice.

10. Disclaimer of Warranties

The Site and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, ARCA disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and uninterrupted operation.

11. Limitation of Liability

To the fullest extent permitted by law, in no event will ARCA, its officers, partners, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your access to or use of the Site, including lost profits, lost data, or loss of business opportunity, even if ARCA has been advised of the possibility of such damages. ARCA’s total cumulative liability arising out of or relating to the Site is limited to one hundred dollars (USD $100).

Nothing in this section limits liability that cannot lawfully be limited under applicable law, including any fiduciary duties ARCA owes to a client under a separately executed representation agreement.

12. Indemnification

You agree to indemnify and hold ARCA harmless from any third-party claim, demand, loss, or expense (including reasonable attorneys’ fees) arising out of your unlawful or unauthorized use of the Site or your violation of these Terms.

13. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

14. Modifications

We may revise these Terms at any time by posting an updated version on this page with a new “Last updated” date. Material changes will be flagged at the top of this page for at least 30 days. Your continued use of the Site after revisions take effect constitutes acceptance of the revised Terms.

15. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict of laws provisions. The exclusive venue for any dispute arising out of or relating to these Terms or the Site is the state and federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.

16. Severability

If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and any separately executed representation agreement between you and ARCA, constitute the entire agreement between you and ARCA regarding your use of the Site, and supersede any prior agreements on that subject.
